1. Agreement to Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you and Mound Power ("we", "us", "our") regarding your access to and use of the Mound Power mobile application, this website, and the companion Bluetooth pitching plate hardware (collectively, the "Service").

By purchasing our hardware or creating an account on the mobile app, you confirm that you have read, understood, and agreed to be bound by these Terms.

2. Product Use & Athletic Safety Disclaimer

• Safe Playing Surface: Users are responsible for inspecting the pitching mound, turf surface, and surrounding field area prior to placement. Ensure the plate is placed flat and free of debris.
• Proper Cleats: The plate is engineered for standard baseball and softball cleats. Use equipment within standard sport regulations.
• Physical Exertion: Pitching involves high rotational stress. Athletes should adhere to recommended pitch counts and rest periods. Consult a sports medicine physician if discomfort arises.

3. Video Recording & Consent

The mobile application facilitates synchronized video recording of pitching reps. By recording individuals:

• You represent that you have obtained the requisite consent of any athlete, parent, coach, or bystander appearing in the video.
• For youth athletes under the age of 18, recording must be conducted under the express authorization of a parent, legal guardian, or official team coach.

4. Hardware Purchases, Warranty & Shopify Checkout

All hardware orders and pre-orders are processed through our merchant store on the Shopify platform. Purchases are subject to Shopify's checkout policies in addition to the following:

• Standard Warranty: Each new Mound Power plate includes a 1-year limited warranty against defects in materials and craftsmanship under normal athletic use (2 years for the Coach & Academy Pro Bundle).
• Returns & Satisfaction: Undamaged hardware may be returned within 30 days of delivery in original packaging for a refund less applicable shipping fees.

5. Mobile App Subscriptions & Billing

If premium coaching tiers, multi-roster analytics, or biomechanics export features require an auto-renewing subscription:

• Subscription pricing, renewal frequency, and trial periods are explicitly displayed in the Apple App Store or Google Play Store listing prior to confirmation.
• Subscriptions are billed to your Apple ID or Google Play account and renew automatically unless canceled at least 24 hours prior to the current cycle end.
• Cancellations and refunds are managed directly through your device's App Store account settings.

6. Intellectual Property & User Content

The Mound Power brand, logos, hardware industrial design, firmware, software code, and analytics algorithms are the proprietary property of Mound Power.

Your Pitch Data: You retain complete ownership of all pitch videos and biomechanical logs created with the app. You grant us a non-exclusive, worldwide license solely to host, process, and display your data back to you and your authorized team roster.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Mound Power shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from athletic injury, loss of data, or equipment misuse. Our aggregate liability for any claim shall not exceed the amount paid by you for the hardware or service giving rise to the claim.
